As I type this I have just finished driving all over Candlewick looking at proposed additions, culverts, and yes, trees people want to remove. Why in the world The ECC must authorize a person to cut down their own dead, dangerous, or unsightly trees is beyond me. Still worse are the fines imposed if a P.O. doesn’t comply and wait until we O.K. the request. To me all a P.O. should need to do is file a paper with the association office indicating they will be cutting trees and prove they are insured for damages if there is a mishap. That’s it….. no ECC approval and no fines unless the trees are cut without providing proof of insurance. It is ridiculous having multiple ECC committee members driving around looking at trees. You own these trees, not us.
This is something that must be changed in the re-writes of the CC&Rs and ByLaws. We will have to re-write and pass these anyway to be legally in sync with the new state law so this is the golden opportunity to get rid of some of the ridiculous provisions.
