O.K., what’s with the attorney change?

Let’s discuss this for a minute. With the passage of the new CICA law in Illinois we will be forced to change our CC&Rs to be in compliance with the statutes. Last year many thousands of dollars were spent in a fruitless effort to change these documents but it was pointless since we still would have not been in compliance plus the new documents were so impossible to interpret I personally could not support them anyway. Currently there are amendments to the CICA law close to passing that will again change the requirements under CICA. We need very knowledgeable guidance to accomplish this as well as someone who can answer all questions for the P.O.s prior to any vote to pass the amendments. We did not have that before in my opinion.

Scott Pointner of the law firm Rathje and Woodward fills the bill. He is well versed enough to have an online presentation discussing the topic of CICA that is creditable to attorneys. Upon meeting him he is obviously someone who is on the ball, likeable, explains issues in non-legalese, is proactive rather than reactive, and to top it off he will offer his services at a lower fee structure than we are currently paying for legal services. This appears to be a winning combination.

Back to the CC&Rs rewrites. Everyone needs to know that legally we will have to make changes to be in compliance. This is not optional. Most of you know I fought against the last attempted re-writes so you know I am not going to just go along with anything thrown at us. I guarantee if I do not understand some provisions I will not let them go unchallenged. I also will tell you when I am comfortable with the new documents and I hope you will trust my honesty on this subject. Fifty percent plus one of the property owners must vote yes for these to pass and all will have a chance not only to read them but also to ask questions before a vote is taken. This will be months away but it needs to be covered so you know what is going on. Your interests will be protected.
